Plasticovershoot.earth (“The Website”) is owned by EA – Earth Action and is subject to the following Terms and Conditions of Use ( “Terms and Conditions”). These Terms and Conditions also apply to our Social Media pages (“Social Media”).

By accessing and using the Website and/or our Social Media, you acknowledge that you have read, understood, and accepted these Terms and Conditions as well as our Privacy Policy. If you do not agree to these Terms and Conditions or our Privacy Policy, please refrain from accessing or using the Website or our Social Media.  

You agree to be bound by all parts of these Terms and Conditions and any modifications or updates that may be made from time to time. It is your responsibility to review these Terms and Conditions periodically for any changes.  




1. Access to the Website and Social Media  

The plasticovershoot.earth website and the Social Media pages are accessible free of charge to any user with internet access. The user is solely responsible for all costs associated with accessing the Website, including hardware, software, and internet access. It is also the user’s responsibility to ensure the proper functioning of their computer equipment, mobile phone, and internet access.

The information and content provided on the Website and Social Media are intended for informational and educational purposes only and should not be construed as legal, financial, or professional advice. EA – Earth Action does not guarantee the accuracy, completeness, or reliability of any information or content on the Website or Social Media, and the user acknowledges and agrees to use such information or content at their own risk.

Users are prohibited from misusing the Website or Social Media pages, and from processing via the Website and Social Media any material that: 

  • Is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience; or 
  • for which you have not obtained all necessary licenses and/or approvals; or 
  • which constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the rights of any third party, in any country in the world; or 
  • is technically harmful (including, without limitation, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data).

EA – Earth Action, its agents, contractors, or licensors shall not be liable for any loss, injury, or damage (including but not limited to direct, indirect, punitive, or consequential loss or damage, loss of income, profits, goodwill, data, contracts, use of money, or loss or damage arising from or connected in any way to business interruption. whether foreseeable, known, or otherwise, and even if advised of the possibility of such damages, and whether in tort (including negligence), contract, or otherwise. This includes without limitation any contingencies beyond its control in procuring, compiling, interpreting, reporting, or delivering data, and for conclusions, decisions, or actions derived, made, or taken based on the use of the Website or any part thereof. 

Nothing herein excludes or limits the liability of EA- Earth Action (i) for fraud or gross negligence, (ii) for death or personal injury caused, (iii) or which may not be excluded or limited under the applicable law. 

You agree to defend, indemnify and hold harmless EA- Earth Action and its agents, contractors and licensors and the respective directors, officers, employees, agents and independent contractors from and against all damages, claims and expenses, including reasonable attorneys’ fees, arising out of or in connection with your misuse of the Website, i.e. any use of the Website which violates these Terms or any applicable law or regulation. 

4. Modifications of the Terms and Conditions 

We reserve the right, at our sole discretion, to modify these Terms and Conditions at any time. We recommend that you check the Terms and Conditions periodically for changes. The use of the Website and Social Media pages, once changes to these Terms and Conditions have been published on the Website, constitutes acceptance of those changes, whether or not you have reviewed them. 

5. Applicable Law and Jurisdiction  

Our website is subject to several data protection laws, including the Swiss Federal Act on Data Protection (LPD) and the Ordinance to the Federal Act on Data Protection (OLPD) for Swiss residents. We are also subject to US data protection laws, including the California Consumer Privacy Act (CCPA) and the General Data Protection Regulation (GDPR) for EU residents. Additionally, we comply with the European Union’s General Data Protection Regulation (GDPR) to protect the rights of our users in Europe. Any use or adaptation for commercial purposes, including for promotion of any 3rd party offerings, is subject to written approval by the author of this material. 

6. Use of contents 

Our website and Social Media accounts may feature diverse content, including but not limited to text, graphics, images, videos, and other materials that are owned by EA – Earth Action. You are permitted to use this content on your personal social media accounts and/or website, but such use must adhere to the terms and conditions of the respective social media platforms, applicable laws and regulations, as well as our specific “How to Use” section, which outlines guidelines for content usage. 

7. Intellectual Property 

You acknowledge and agree that the content on the Website and Social Media accounts, including but not limited to copyright or other intellectual property or unfair competition or misappropriation laws, is and shall remain the property of EA – Earth Action and/or its licensors. Such content may only be used in accordance with these Terms and Conditions, any other agreement between you and EA – Earth Action, and all applicable laws and regulations. Unauthorized use of the content is strictly prohibited. 

8. Prohibited conduct 

You shall not use our website or Social Media accounts for any unlawful, abusive, harassing, threatening, defamatory, obscene, offensive, or otherwise objectionable purposes. You shall not engage in any activity that may disrupt or interfere with the functioning of our website or Social Media accounts, compromise the security or privacy of our website or Social Media accounts, or infringe upon the rights of others. You shall not impersonate any person or entity, or falsely represent your affiliation with any person or entity, in connection with your use of our website or Social Media accounts. 


EA – Earth Action is committed to providing access to certain content for personal, non-commercial use on social media accounts or websites, including but not limited to Social Media, through reposting, sharing, or other forms of distribution. However, it is important to note that the content must not be altered or modified in any way, and proper credit must be given to  Plastic Overshoot Day by tagging our Social Media accounts or mentioning our website in the caption or description of the content. 

9. How to use our contents on your website or in your communications

If you wish to use our content on your website or your communications (Newsletters, email updates etc.), you are required to provide credit to the plasticovershoot.earth website in the caption or with the description of the content. 

10. How to use our contents on your social media 

If you want to post our content on your social media accounts, you must either give credit to the plasticovershoot.earth website or tag our relevant social account in your post.

11. How to get access to the assets  

You are free to use some of the assets from our website or social media platforms. There are no charges associated with accessing these assets. To obtain the appropriate assets, ycomplete the contact form by clicking on the below “Partner with us” button and we will provide you with the necessary materials.
